Sir,
I filed partition suit against my sister who is occupying the property which is in my mother's name . My mother died intstate and my sister fraudently occupied the property on fabricated Will. I appealed in the high court and will was negated and highcourt passed preliminary decree declaring shares. I filed final decree proceedings and my sister and her children are trying to prevent me from taking either legal action or any help from outside. They threatened me and filed false cases against me. Unless court completes the final decree I cannot sell my share. Even if I sell my share to third party I feel threatened by them. What is to be done either I should proceed legally or take some private persons help. I am financially not well and retired from service. Can you suggest any remedy to resolve the partition suit.

I would be glad if you suggest or help to resolve my problem

A.Hi,
In addition to the partition suit, you can file a complaint against them for cheating and fraud under Sections 415 and 420 of the Indian Penal Code. You can also complain about criminal intimidation under Sections 503 and 506 IPC. A stay or injunction order can be obtained on the preliminary decree.

A.Hi,
In addition to the partition suit, you can file a complaint against them for cheating and fraud under Sections 415 and 420 of the Indian Penal Code. You can also complain about criminal intimidation under Sections 503 and 506 IPC. A stay or injunction order can be obtained on the preliminary decree.
