Cheque bounce Cheque bounce

I have a commercial property which I rented out in August 2020. 11 month notarized agreement , tenant had given my 6 post date cheque as advance for next 6 months rent as part of agreement. His two cheque got bounced due to insufficient balance and I got the notice of the same on 15th December in written from my bank. Cheque amount is 10K each, what is my right here. Can i issue a notice and go to file a case under 138 if notice not answered. Please suggest

A.Dear Client
You issue a legal notice to your tenant claiming the amounts due, else file a complaint in the court under section 138 of NI act

A.1. You may file a case under sec. 138 of NI Act.
2. Alternatively, you can file a summary suit under Order 37 of CPC for the recovery of the amount.

A.Hi,
Yes you may initiate with both, first send him a legal notice and then, file a case against him.
