I got married in april 2015. I had been mentally tortured by my inlaws for 2 years. In march 2017, my husband beated me and i got minor injuries as well. Then, i filed a domestic violence complaint against my husband and my inlaws. In that complaint, i mentioned that they asked me for the gifts by the name of rituals. However, at that time, we compromised and me and my husband along with our son started living separately from inlaws. Since then, whenever i talk to my husband regarding returning the gold jwellery and other electrobnic items which had been given to me by my parents on my marriage, either he starts fighting with me or stop talking to me. Now he is saying that he is insecure, that if he gives me all my dowry back, i may complain again for dowry not returned. What surety i can give him to take back all my dowry?

A.Dear Madam,

If you are residing separately then the question of returning dowry arises. Even otherwise you may acknowledge receipt of all the dowry amounts/articles by way of executing on Rs. 200 stamp paper with signatures of yourself, your parents and witnesses. This document is sufficient for him.

A.First of all you need to worry and don't need to give any security, its your right. And firstly you maje it clear that you want your relationship more or not, if not then take the step and file a complaint u/s 498A, 406 ipc and u/s 125 crpc for maintenance or finally u take divorce by mutual consent and set a amount as permanent alimony and demands your jewellery and other items as the terms of divorce

A.If ur husband is living with u, there is no need to worry as living together is more important jewellery. Jewellery is an asset but human relationships are the real assets. So as far as ur are peaceful in your house with ur husband, don't bother for jewellery. But in case some dispute arises in the future, you can claim ur jewellery at that stage. Such matters have to be sorted out tactfully and not with a hot mind.
