we are 3 children and father and mother in our family.on 2008 my parents written a will for giving 7 cent land and 1000sqft house to my second elder brother on agreement second brother has to give 2lakhs rupees to my 1st brother .but after 2years father died and second brother is not looking after my 72 year old mother.now she is with me.i am the youngest in the family.,but no share was given to me so far and my mother is no house to live.this will and partition are taken place without my consent or knowledge.what legal protection will get my my mother for retaining the house|?

A.You can file a partition suit if it is an ancestral property. Your mother can claim maintenance from your brother who has taken the property

A.Hi,
If the property is ancestral property, then you may file a suit for partition of property in a court of law and claim your share, if any.

A.Hi,
More information is required regarding the fact whether the property was ancestral property or not.
If the property was ancestral property, then you may be entitled to receive your share in the property.

Your mother may file application before Senior Citizens Act and get monthly maintenance from your brother who has taken property.
