I reside in a housing society which is registered. The housing society is approx 6 years old. Recently few of top floor owner are experiencing water leakage from the roof inside their home during rainy season. I just wanted to know who is responsible for roof repair, is it owner or housing society or both. Please suggest.

A.Hi,
Society is bound to carry out terrace repairs, if society refuses file complaint against society before consumer forum and seek orders to direct society to carry out necessary repairs.

Society will undoubtedly do the repairs, if society declines legal notice against society before consumer forum and look for requests to guide society to complete important repairs.

A.1) Please read your agreement and society's rule and regulation include the Memorandum of Society.
2) Give legal notice to the Chairman of society through an advocate.
.3) Read section 23 :-
In the event of any dispute arising among the Committee or the members of the society, in respect of any matter relating to the affairs of the society, any member of the society may proceed with the dispute under the provisions of the Arbitration and Conciliation Act, 1996, or may file an application in the District Court concerned and the said court shall after necessary inquiry pass such order as it may deem fit.
