Frequency of revision of maintenance granted under section 125 crpc
3 years ago
My wife was granted monthly maintenance under section 125 crpc. Its almost a year and I have been paying the maintenance amount since the judgement day. As one year is going to complete, can she file a revision petition and ask for increase of the maintenance amount? Also may i know the criteria for revision of amount?
A.Yes if your income increases and if she comes to know about it then she can file revision petition and ask for increase of the maintenance amount. So hide your income if you are getting in cash.

A.Hi,
The amount of maintenance depends on your ability to pay. If the Judge discovers that you have plenty of disposable income while your wife is leading a comparatively frugal life, they can increase the quantum of maintenance.

A.Hi,
The decision is based on your ability to pay, and is determined by the Judge to provide your wife with enough to maintain the same standard of living she was used to, with you.
