Non issue of promotion

I was due for promotion to the rank of Naib Subedar in the month of Jan 2019. however the same has not been issued by till date . I lodged complaint in HUMRAZ ARMY APP. They reply me that your not eligible for higher rank due to not meeting Annual confidential report criteria. Now I want to go Statuatory complaint. Now presently Iam in low medical category as A2 permanent in knee. Due extreme cold in J&K sector I enable do the job due to pain in knee. Now I will apply for unwillingness for Service from Army. I can now lodge Statuatory complaint ?.

A.Hi,
Ordinary Courts do not have jurisdiction to implead the Army as parties to the proceedings, except in exceptional circumstances. As such, you are better off trying to sort this matter out internally along the army's chain of command. They have the discretion to promote or demote anyone they wish.

A.Hi,
You can lodge a complaint, but it is unlikely to gain you anything. The army has the discretion to not promote you if you do not meet their report criteria.
