I am owning a flat in an apartment since May. 2014 and it has no RWA but unregistered RWA is collecting money in the name of maintenance since May. 2014. They are neither giving the receipt nor giving audited financial report since beginning. They are not initiating the procedure for registration of Association. When questioned about their their legal identity, they threaten the residents. The Closing balance of Cash in hand as on Dec 2020 more than 75,000/- and Bank Balance more than1,60,000/-. Please tell me how to take up this matter legally.

A.Hi,
File a civil money recovery suit against them. You can complain to the police about criminal intimidation under Sections 503 and 506 IPC and have the Court pass an injunction order against the functioning of the RWA.

A.Hi,
You can file a case against the society or its management under Sections 503 and 506 of the Indian Penal Code for criminal intimidation.
If they are an unlawfully constituted body, you need not pay them anything. You can file a civil money recovery suit to recover your losses.
