Based on the development agreement made for ulc scheme and irrowakebal power of attorney, the developer has given Rs. 25 per square meter is paid to the guarantor then the ulc scheme is canceled and the direct plot is sold which we have taken. If the guarantor dies and his inheritance is sold to someone else, then who has the right and according to which law?

Yes after the death of the guaranter an Application for substitution of legal heirs have to be filed to bring on record the legal heirs of the guaranter and therefater they can contest the same. If the bank has done fraud you should file a Criminal Complaint against it immediately. If you find this helpful, please rate us.

If a guarantor died, his/her legal representative would continue to be under a liability for the duration of the three-months notice period, if such a notice had been given by the guarantor during his lifetime. If you find this helpful, please rate us.
