I am currently living in Australia and willing to apply for an application for re-issue of my passport as my current passport is due to expire soon. My Old passport was issued in 2011 without any issue and i migrated to Australia in 2016.

We have a land dispute with my uncle and due to this fact he made a fake complaint against me and my brother in 2016 under IPC 504 which was closed by local police station and they filed a FR (Final Report) as matter was of no significant purpose. Later my so called uncle, reopened the case by giving application in magistrate court and it seems the case is still pending in court.

I want to ask you if this obstructs my right to obtain my passport and if so what can i do to settle the matter in due time ? I asked another lawyer and he said that there is no record in police station as FR was submitted and there won't be any issue with clearing police verification.

A.Hi,
As the original case was closed, there should be no bar on your passport being re-issued.

A.Hi,
No, this should not obstruct your rights to get the passport re-issued. As the case was dismissed, your innocence has been proved.

A.If you leave India, and physically absent in India for a continous period of six months, then you will become and Non resident Indian , and if you become a foreign citizen, then you should surrender your Indian passport to the Indian embassy in your current country of residence
