My grandfather and his Brother cultivate own land 1 acre .my grandfather brother was sold entire land to buyer in 1972. Without consent and my grandfather permission. My grandfather was not signed at any documents. My grandfather died in 2002. Buyer occupied entire land. I and my family members are assumed my grandfather was also signed in documents. Now I am checked Sub- registration office E.C it have my grandfather name on this land. Can I claim my grandfather share 0.5 acres?

A.Hi,
You cannot claim the property back since it has already been sold. But you can claim the half of the amount from your grandfather's brother, and a suit can be filed for the same.Thank You

A.Hi,
You can file a suit under the Specific Relief Act, 1963, to claim a share in consideration of the amount received from the sale of this property. You can also file a case against your relatives for a criminal breach of trust for the sold property.
