Decree Holder to buy attached property

Good day what section of CPC and rule of order 21 are applicable if decree holder wants to buy attached property from court directly instead of auction , the property valuation is done by a govt approved valuer . please guide. Thanks

A.Thank you for asking this question. Various rules of Order 21 - First Rule 65 expressly states save as otherwise prescribed all such sale of attached property SHALL be made by public auction. Rule 72 is an embargo on the decree holder to bid for such property in public auction except with permission of court. Therefore combined reading of these two provisions clearly makes it evident that the decree holder as a matter of routine cannot buy such property even in auction much less without one.
