As per the court orders that my husband should not take us( Myself and my daughter) to where their mother-in-law, father-in-law, sister-in-law and brother-in-law resides because they harassed me physically as well as mentally. Now my husband is again calling us their because he is working from home in their native. My daughter is not getting any kind of love and affection from her father. Only he pays the rent of the house and gives some money to lead the life and sits in his native. At Most he comes 15 days once and then returns back. So in this case what has to be done. Kindly please suggest me.

A.you already have court order.
so you have to take decision that what you wants next.
you can continue to live like this or take divorce.
you can force a person to live with you.

he have to pay alimony/maintenance if you go for divorce.

A.You can file application under Domestic violence act for alleged physical and mental hsrrasment ,also file application for divorce if u don't want to live with him on grounds of cruelty and harassment. You can also file a seperate application for maintenance of yourself and your daughter under section 125 CRPC.

A.Hi,
You can file a suit for divorce with your husband which can also be by mutual consent. As he doesn't live with you, a contested divorce can be filed by you on the ground of desertion. Later, you can claim the custodial rights of your daughter and the alimony/ maintenance can be claimed for, thereafter.

A.Hi,
You can opt for divorce on the grounds of cruelty and desertion or a mutual consent can be filed. After which you can claim the custody of your daughter and the maintenance for both.
