we have 1000 sq yds in gopanpally at hyderabad my site was occupied and constructed by some persons. i filled a case in the court but my advocate did not attend the case. now the situation is the other parties completed the apartment and sold away by some persons. still now my case is pending.i filled the case in 2020 my question is . Is the court give any order to demolish the said building or otherwise take some amount in the market price.(government rate) because the other party advocate told me the court consider the flat owners voice.

A.other party advocate is lying to you to win case.
your lawyer not attended because you not shown any seriousness or paid fees.
why you not took injunction on construction itself ?

now apply for injunction immediately.

A.Had you not prayed for interim stay on ongoing construction? Now you are required to amend your case and implead all appartment owners to whom flats were sold and also to add some additional relief. Subject to what you have sought relief in your case, the court has every power to order demolishen of building.

A.Hi,
Remedy depends on the facts and circumstance of the case. However, if the judgment is in your favour you will be paid the market price more likely than the building being demolished

A.Hi,
If the land is disputed then the sale of such land will be considered contempt of court. Based on the limited facts, it is only advised that you explain the reason for the dispute and if the property is yours then the court will likely provide you remedy by directing the other party to pay you the amount according to the market price.

A.First of all, you should file a written complaint against your advocate for not handling the case properly. Then show the certified copy of that complaint to the court and make request before the court to change your advocate.
This is good that Your case is still pending. If possible, try to get order of status quo at this stage n prove your ownership before the court.
If the other party want to seattle the case by giving you some money, it can also be a good option if the said amount is considerable.
