Will you explain article 65 of limitation act?
Section 3 of limitation act same to this???

A.Hi,
According to Section 65 of the Limitation Act 1963, the statutory period of limitation that is allowed for the possession of immovable property or any interest therein is 12 years. On the other hand, S.3 deals with limitation bar in respect to ordinary suits and appeals.

A.Hi,
Both the sections talk about limitations in filing a suit. The difference between them is that while S.3 talks about suits in general and appeals, s.65 mentions the limitation in filing a case for adverse possession of the property.

A.We can not say that they are same but they are related.
Let us try to understand them.
Section 3 Limitation Act, 1963 talks about the limitation in general for any kind of suit that can be instituted in the court of law which will have a limitation period of 3 years. So. unless a case is files within three years from the date of occurrence of the cause of action it will be considered as barred by limitation. This period of three (3) years is applicable for most of the categories of cases as you can see in the Schedule I of the Limitation Act. The period of three years, in general, is good number of years for anyone to reckon his rights and start a legal action on it.

There are certain matters on which a period of three years may not be sufficient and could be less to reckon and comprehend the rights ( especially rights in land and property). These are the areas where people take lot of time to understand what to do and by the time they go to court for filing a case more than three years would have passed. In 1974 the Law Commission regrouped some of the articles and put different timelines for the limitation period and hence Article 65 in Schedule 1- FOR POSSESSION OF IMMOVABLE PROPERTY OR ANY INTEREST THEREIN BASED ON TITLE- the limitation period was kept as 12 years.
