The West Bengal Waqf board is not giving permission to refurbish our dilapidated building. The Mutawalli is absconding and a third person claiming to be lessee is least interested in the property. Under such circumstances we the tenant intend to repair the building but local office of Wakf board is lingering with the permission. Kindly advise.

A.You may approach court through suit for mandatory injunction and permanent injunction.

A.Hey,
If your issue is not resolved even after complaining in the board then you should approach tribunal established under section 63 of WAQF Act and take help of the lawyer.

A.Hey,
If after numerous application to the board the matter is not resolved then you file a complaint with the help of the lawyer in the tribunal. There are tribunal established under The Waqf Act, 1995 which resolve any disputer related to these matte.

A.If waqf board is not giving permission then then this. Send a copy of that letter to the Municipal Commissioner stating that waqf board is not giving permission and it may cause damage to property and people and you seek their permission to work on the property.
