My wife leaves seperate and I stay with my children's in other place . 7 years old daughter and 10 years old son. Both don't want to stay with mother. My kids now also don't want to speak with my wife on phone they deny all the time. I have filed divorce against my wife six months back. I and my children's are happy together

What to do since my children's don't want to speak with my wife and my wife has now filed several police complaints on Me like abduction, child harrasment etc. ? She also filed DV and asking for childerns. But they don't want to go to her?
I have proofs of her affair as well

A.which police station took abduction case on father ?
complain to SP.

she will not get child custody.

A.Father is the natural guardian of child above five years so no case of abduction or kidnapping etc is made out. The statement and willingness of children also matters. You can refute the allegations. You can file case for your appointment as guardian by filing petition under guardianship and wards Act and also by filing application under section 26 of Hindu marriage Act. You cannot deny your wife to meet children.

A.File a child custody case and let the children provide their statement in the court when they are called to. It will be easier for you to get the custody. Even though the their is a prescribed law but the court will take lot of factors before deciding the custody.

A.Hi,
You can move the court to get the custody of your children. The principle on which custody is decided is the ‘best interests of the child’. Therefore, the parent who can take better care of the child’s emotional, educational, social and medical needs is favored. Further, the consent and the willingness of the children to stay with thier choice of parent is also considered by the court while deciding the case.

A.Hi,
With regards to child custody, the children's interest and their consent is considered by the court, when the child reaches the age of 9 and above. So, if the children are willing to stay with you, you can institute a case of child custody before the competent court in your city and take the custody of the children. If the mother wishes to see her children you cannot stop her from doing so. The matter relating to visitation rights of the mother will be decided by the court.
