My late father purchased property in bihar in 1980 in mother's name (to save tax). I have no job since 3 months due to corona time & currently living with 3 dependent in rented house. I want partition to get my share to feed us & start any shop to survive. My younger brother works as manager in bank & I have no talk since 4-5 years.
Can I file a partition legal case.

A.Hi,
It cannot be partitioned during the father's lifetime since it is a self-acquired property, as the court ruled in 2019. Since your father is no longer alive, you can file a partition suit to recover your share of the property. You must examine the legal heirs and the persons to whom the property will be allocated with attention.

A.Hi,
Since it is a self-acquired property of the father therefore it cannot be partitioned during his lifetime as it was held by the court in 2019. However, since your father has passed away you can duly file a partition suit and claim your part of the property. you have to carefully analyse the legal heirs and the people among whom the property will be distributed.

A.Aap partition ke liye ja sakte hai. Jiske liye aap ko advocate appoint karke court me case file karna hoga. Jisme time bahut lagta hai.
Aap aapas me bethkar partition ki baat kare or uska samadhan kar le to bahut achha hoga.
Court last option hai. Jab sab praysh vifal ho jae tab court aae.

A.No you cannot file a case for partition on this property as this is a self acquired property but you can file case for rest of the ancestral property get the partition done.
