partition suit

i am staying in an unpartitioned house in kolkata. My co-sharers knowing fully well the implications have already rented out to an outsider during the pendency of the suit. The suit was filed in 2009, now is the time when court is expected to hear proceedings for witness. Now my question is when the partition commissioner comes for partition will he leave aside the tenanted portion and partition my portion which is vaccant ?

A.All the properties which are given in plaint are subject to partition

A.the property in question will be considered as whole and the commissioner will report on the whole subject property.
