Zilha parisad school again students right
2 years ago
The land in my village has been donated by a farmer to the Zilla Parishad school. But the same land is used by the school headmaster and the school education committee to use the land for farming. We asked the headmaster and the education committee and the village sarpanch and gram sevak and they got the only answer that from this money we do the repair work in the school. But the school does not even have a playground for students to play. The playground is not available for outdoor play due to lack of student playground. The farmer had given the land for the welfare of the student but the school uses it for its own benefit and to earn some money. The student is suffering due to non-availability of playground. What do I have to do to get the land donated to the students for the playground?
Since land was donated for a specific purpose and it is not being used for the said purpose. On that ground you can issue a legal notice and try to get back such land by cancelling donation as the beneficiary violated the terms of donation.

This amounts to criminal misappropriation of property and criminal breech of trust. If that property is transferred for the welfare of students, it can't be used by anyone for their own benefit. I don't find it logical to use that land for earning money even though they are claiming that they will use that money for the repair work of the school. Doing repair work is the responsibility of the management.
Thank You.
Since you mentioned that the farmer has donated that land to the school for the welfare of students and if that land is misused by anyone, that would amount to criminal breach of trust and criminal misappropriation of property according to IPC. Here all those who involved in this act will be prosecuted and they have no right to use the land for anything else other than for what it has been donated.
