Character assassination by my sister and how law protects me?

I am an NRI and my sister made false allegations to my family members that I had slept with her husband with the intention for my family members to hate or disown me. Her allegations are false. She also claims to file false cases against me with the intention to beg me down to release my share of the property to her. How does the indian law protect me?

A.Being NRI also you are an Indian citizen so Indian laws apply to you. If you have proof of allegations as levelled by your sister then you can serve her notice for defamation and ask her to desist from levelling such bald allegations. You can also report the matter to police.

Your sister has no right to defame you by saying that you have slept with her husband if it's isn't true. Therefore you have a right to file a defamation case against your sister. Also she cannot force you to leave your share of property. But it would be suggested to solve the issue amicably in order to avoid lengthy process of Indian courts.

You could file a defamation case against your sister for spreading fake news about you sleeping with her husband. Also you can only be not given your share of your ancestral property in case your parents leaves a will stating that you sister will be the owner after that.

A.You filed a police complaint against the opposite party. They harreshment me. Without any reason. Opposite party try to my property. How can use and possession the your property.

A.File a criminal defamation case against her if she has filed false and frivolous cases against u and if she has spoken in public or published or filed any defamatory substance.You can also file a criminal complaint against her before JMFC Court.

A.Written defamation is called "libel," while spoken defamation is called "slander and Your sister is trying to defame you both by libel and slander against which you have both the civil and criminal remedy because in India, defamation is both civil and criminal offence. Under criminal remedy for which you have to come to India to lodge complaint, if such defamation is proved, then under Section 500 of the Indian Penal Code,1860,as amended up to date, your sister can be punished with simple imprisonment for a term which may extend to two years, or with fine, or with both.
Please take note that you have the legal remedies available depending upon what kind of false allegations and cases so to be filed by your sister but before that you have to give notice to your sister giving warning regarding the costs and consequences of defaming you.

It is so cruel allegation and you can take civil and criminal action against her. You may get issue a legal notice and then file defamation case under Section 499 and 500 of Indian Penal Code. Further, you can file civil defamation case claiming huge compensation for demoralizing your character.
