i stay in a pagdi flat in mumbai have made a partition between two rooms without the consent of the landlord as we have already filled a case against the landlord to prove his ownership. Can he evict us also there was ongoing work in the house through MAHDA can we use it to are advantage.

A.Hi,
The only process and reasons for the eviction of the tenant by the landlord Non-payment of rent after 15 days has passed after the due date. Therefore, if your case does not fall into any of the above things then you can be least assured that there would be no problem from the end of the landlord. Also given the fact that there is a case running any decision would be under the court to be decided.

A.Dear Sir,
During the pendency of a case before the Court the landlord cannot evict you. He has to establish so many things as claimed by you that is his ownership etc before getting favorable orders by him.
