Knowledge of rash driving can lead to badily injured someone

A is rash driving on a narrow road which is normally vaccant everyday ...bt A has a knowledge that his rash driving can Vasily injured somebody or even cause death ..he hit somebody (B) and B is dead on spot ..
My question is under what section he will be put section 299 or section 304(A)
Because although A has not intention of killing someone bt he has the knowledge that he can hit someone

You have to approach the High Court or file an application before the Trial Court to alter the charge. The High Court will look into the allegations made in the charge sheet and the offence may be altered to 304(A) from Section 299 of IPC.

If such an event of such rash driving has happened then a case of 304(A) of IPC would filed against the person driving the vehicle.
304-A IPC is causing death by negligence.

Punishment. After proving the person liability under Section 304A of the Indian Penal Code it becomes very important to punish those offenders. The punishment for death which is caused due to the negligent or rash act of the accused is prescriber under Section 304 A of the IPC itself.
