Time limit to appeal to Supreme Court Time limit to appeal to Supreme Court

Judgement came out from Bangalore Highcourt on 8th of December 2020. Copy obtained on 4th of March 2021. It is already more than 5 months from the date copy obtained.

Considering the Covid Situation / Lock down, Does my opponent still have time to appeal to Supreme Court ??

A.Hi,
The limitation period is 90 days. You can check the official website and find out if there is any relaxation for the limitation period due to corona. He can also approach the court under section 5 of the limitation act.

A.Hi,
Please contact a lawyer to know the limitation period for the same. The court shall issue such notification in case of any extension in that limitation period and you can find it on the official website.

A.Dear Sir,

The limitation for filing of SLP is 90 days from the date of the High Court's order. The time taken by the Court from the date of filing of application for certified copy of the order till the copy is ready for delivery is excluded from the computation of the period of limitation.

A.The matter becomes time barred for appeal, however,if your opponent prefers to file Special Leave Petition to Supreme Court for allowing his appeal,then through the application under Section 5 of the Limitation Act,he has to give justifiable grounds for condonation of delay in filing SLP.

A.Normally the limitation is 90 days to appeal but considering the Covid19 situation you may ask for condonation for delay so you will require to file an application to that effect stating the necessary reasons in accordance. Thank you.
