Property Rights for Adopted Child Property Rights for Adopted Child

1. My parents have adopted a baby girl 24 yrs ago, we treated her as our own family member, spent enough money for her studies and learning additional skills. Unfortunately, she is not capable of learning the skills. She now ran away by stealing some money, jewels and valuable items from home. Now, we found her and she got married to some one.
2. We didn't create any record for adoption and her school records, gov id's all have my parents name as her parents.
3. Now, we would like to get a release from her. What rights she has on the family assets and how to sort this legally.

A.Hi,
1) She has equal rights over the property even though she is adopted and since there are no records to prove the adoption, she might be treated as a natural child and the property rights remain the same.
2) You can get a release deed signed by her by talking it out amicably. However, she has right to equal partition and can get equal share in the property.

A.An adopted child has same rights in the property as the natural (born) child of a parent and there is no way the adopting parents can force the adopted child away from his/her property rights. In your case if the adoption was not legally done then it might be abit difficult for her to prove the adoption ( her school records can help her to establish that, but only when court agrees).
