I rented my premise for the commercial purpose to 2 persons. They subleased to the 3rd person. None of them is paying the rent based on the agreement done by 1st and 2nd persons.

The original tenants are not attending the trial. However subleased 3rd person agreed that he is running the shop at the court. This is against the terms of the agreement.

At this stage,

1) Who is responsible to pay the rent to the landlord?

2) Do we need to argue that that the subleased person is responsible to pay the rent based on the agreement done by the original tenants?

3) What is the case law tells about this?

A.Hi,
You can sue the tenants. They have to follow the terms and conditions mentioned in the agreement and in case of a breach, you can approach the court. You have the right to get your rent along with the interest for delay. In case of any further losses you had pursuant to it, you can claim that too.

A.As per your rent agreement your tenant is supposed to pay the rent and you should be least bothered about the subtenant paying or not. As you mentioned that sublease was against the original rent/lease agreement hence you cannot seek the rent from the subtenant.
