Sir,
We two brothers hv shared 6 acres agricultural land in village of kashipur tehsil. Since August 2021 submitted Case of partition of land by me is in process in Chakbandi Adhikari Court kashipur as land in still in Chakbandi. Since July 2017 without my consent/permission my younger brother has given my share land also for agriculture use to third person Mr.Madan Singh and still Mr.Madan Singh is using this land so kindly guide me how i can claim contract money from Mr.Madan Singh. Can i submit this claim from other court other then Kashipur as presntly i m not staying in kashipur. Regards.k.singh

A.Hi,
You have to file the suit in the kashipur court itself. The jurisdiction of a court is very important for filing a case. You can brief your issue to a lawyer and get legal advice.

A.No you cannot submit your claim other than the local jurisdiction where the land is situated. What you can do is that either you can move an application in the court where the suit is going on for stay of any activity on the land or to pass an order to give you the share of the money owing to the contract farming. Speak to your lawyer and discuss with him
