My brother removed all the money from the bank after my father death. He filed an affidavit saying he will be responsible if any one comes to claim.
We are four legal heirs including my brother.
Nominated owner was my mother who died well prior to my father's demise.
What step should be taken and what charges would be framed against my brother?
Is he liable for a criminal case.

A.Hi,
You can move legally. You can claim for your share and if your brother claims the amount with mala fide intention, you can sue him for criminal breach of trust, cheating, and fraud. You can file a civil suit for getting your share.

A.Fraud and cheating and breach of trust are the charges which can be pressed in this case if you plan to lodge an FIR but honestly the nature of this case is civil so probably filing a civil case for money recovery stating your reasons in accordance of Hindu Succession Act may prove better if filed. A.You can file for succession certificate to ask for your right in the money that was taken away by your brother. Simultaneously you can file a criminal complaint to police citing fraud and cheating and initiate the criminal action too.
