A.It is necessary to lodge complaint before the Cyber crime Cell to take appropriate action as per Law. If that person is your sister's known acquaintance, then she can lodge complaint / FIR in local police station also in this regard along with call recording because as per the Indian Penal Code,1860,as amended up to date, there are penal provisions under which FIR can be lodged on this issue.
Section 354A of the Indian Penal Code: , any person requesting for sexual favors or making sexually colored remarks shall be guilty for the offence of sexual harassment punishable with imprisonment up to three years and/or fine.
Section 354D of the Indian Penal Code: if a person constantly contacts a woman for initiating personal interaction in spite of her disinterest then he will be punished with an imprisonment of three years and fine.
Section 506 ofthe Indian Penal Code: any person committing the offence of criminal intimidation shall be punished with an imprisonment of up to seven years and/or fine.
Section 507 of the Indian Penal Code: If any person tries to threaten or intimidate a woman through anonymous communications then he will be punished with an imprisonment of two years in addition to the punishment provided under Section 506 of IPC.
Section 509 of the Indian Penal Code: if a person insults modesty over a phone call then he will be liable to be punished with imprisonment up to one year and fine.
