Police Station In-charge is not registering FIR for illegal mining of my agricultural land and he is telling it is the matter of mutual division of property.I have sent the complain letter to SSP, DM, Commissioner and Chief Minister for registration of FIR for illegal mining of my agricultural land (soil is extracted upto depth of more than 12 ft ) and also mining is done without any permit. I have attached gps photographs of mining activity of my land.
What is the legal provision to register FIR???

A.Dear Sir,
You may also try by lodging private complaint under Section 200 Cr.P.C and get it referred to the Police Station under Section 156(3) of Cr.P.C. for immediate issuance of FIR.

A.If your local police station is not lodging complaint, then under section 154 (3) of CrPc you can write complaint to Superintendent of Police. If you are not getting remedy from SP, then under section 156 (3) of CrPc you can approach magistrate

A.Dear client,
If you believe that the police has rejected your FIR for an invalid reason, then you may complain to the nearest judicial magistrate u/s 156(3) read with Section 190 of the criminal procedure thereby requesting the FIR to be registered by the police and commencing investigation into the matter.
