My wife has filed wrong DVC case 3 years back. In the affedevit she has falsely mentioned that she has no means of earning and obtained maintenance order from the court. I approached her company and obtained her experience letter.

Question:
1. Do we need to file a separate 193 ipc case against my wife in the lower court or can we give a 193 ipc petition to the same DVC case court.

2. What is the time limit or limitation for filing 193 ipc in the lower court. Since it is a criminal case I think there will be no time limit. Please confirm.

A.Dear client,
Hon'ble Supreme Court held that private complaint alleging offence under sec 193 IPC is not maintainable. You can file petition under section 340 Cr.PC read with 195 (1)(b) Cr.PC and then court proceed for case of false evidence.
