sir we got the from additional metropolitan court in dvc case in that order she did not prove any thing regarding what she put allegations so we now can use that order in 498a case to prove our innocent

Yes you can file an application for the same and burden of proof lies on the accused guilty of an offence without any reasonable doubt reasonable doubt is always on the prosecution. So, prosecutions have to prove their case, if fails then it may end with acquittal of accused.

A.You cannot 100% rely on the order to prove your innocence on the basis of the order but yes you should use that as a supportive document for your 498A case and the court will take that into cognizance with the help of your lawyer so that you ca take the benefit of that during the argument.

A.It seems that only interim Order has been sent to you for necessary compliance. To give opinion, It is necessary to scrutinize that Order for its scope, meaning, effect and legal implications. It is also necessary to know whether any date has been specified in that Order directing your appearance before the Court of Law.
