Cancelation of granted bail.
I purchased 4 shops from a builder in 2009 through registered sale deed. The builder never formed society and constructed temporary stalls on the open marginal space and on the parking of the commercial complex and rented it out. He even sold one of our common toilet as office by way of notarized deed. The builder has a long history of criminal record which includes acts like IPC 326,307,306 so I refrained myself from taking any active action against this illegal construction. In February 2021 when I had enough of his atrocious behaviour started writing letters to the authorities regarding demolition of this unauthorized construction. The builder was triggered by my complaints to the municipal authorities and started threatening to kill me by sending goons to my shop but I did not pay heed to the threats and focused on my legal actions. In March 2021 around 10 people entered my shop including the builder and started beating me and my father. We called up the police immediately and retaliated against his aggression in which we got injured but managed to injure the builder too with fists.
An FIR was registered U/s 327,326,427,504,506 IPC against the builder and a cross FIR was registered against me too. We all got bail the next day. I never stopped pursuing my legal actions against him even after that so he wants to shut me down with voilence and false cases of molestation.Since then, the builder threatens me with direct and indirect ways like his goons walk with iron rods in their hands infront of my shop staring at us.
Last week he threatened my workers who also happens to be the witness in my case to leave the job atleast for a month because he is planning to inflict some serious injuries this time. Can he attack us again if he is on bail? What actions can I take to prevent this from happening?
A.Dear Sir,
You may approach your public prosecutor who is your advocate to move an application to get cancel his bail.
