my wife was expired in jan 2020 delivering my son and my son is now 2 years old.i have got court notice from my in-laws to get the guardianship of my kid( and properties associate to him). I am non smoker,non alcoholic, had a good job to raise my child as well. I didn't had any second marriage yet. So is there any way my in-laws can win this case? And how much of time this case can go long to get the judgement ( on an average).

A.Dear Client,

Generally, the parent has the right over the custody of a child, but in your case, if for the past 2 years the child was residing with your in-laws then the court will decide what is best for the child's welfare.

A.To give opinion, it is necessary to know after your wife's death who had nurtured the new born child and what sort of responsibilities you are taking for that child and in whose custody that child is at present and what are the economic situation of your in- Laws.

myself(my family ) nurtured the new born and in my custody for all these 2 years.

Responsibilities : deposited fd for my child future ( education purposes ) .
Celeberated all the events in his life as I can.

what are the economic situation of your in- Laws.

My father in laws age is 65 retired employee ,mother in law age around 60 house wife.they were surviving on there pension amount.

As father you are the natural guardian of your son, more particularly because your wife is not alive and as you are performing your responsibilities properly so till you marry for the second time, your in-laws have very little chance to succeed on this issue, however, none can predict the time to conclude such litigation.
