Breaking Notice period in Corporate

Hi, I work for an MNC (IT), which has 90 days notice period. I have resigned a month ago. I requested for an early release and mentioned my willingness to pay for the 2 months which I will not be able to server as per agreement commitment. HR has rejected my request, nor accpeted the buy out.
Now, if I stop going to office from 31st day of notice, and join the new employer on 40th day of notice, will the current employer charge me for dual employment?
-My current employer has mentioned in the seperation policy that I will not be getting my relieving letter if I stopped attending work without authorisation. Can they hold the relieveing letter?
-Also its mentioend that the Service certificate will contain remarks pertaining to the circumstances of the employee's exit.
-Will this impact my background check?
If you do not have proper relieving letter then you might be accused of the having dual employment which can cause serious problem in you future employment. Also the background verification will negative for you.
