Dear Sir,
I have a joint property. The property was not partitioned. But my co-owner sold half of the property without my knowledge. Also while selling they removed my half name illegaly in the 'Patta' and sold to third party. My co-owner was expired also and he do not have wife/son/daughter. Now the buyer demanding for the sold property. Could you please advise, how can I proceed legally.
Thanks.

A.Dear Sir,

Without boundaries defined how it can be sold. It seems landed property and without boundaries it cannot be sold however get the copy of sale deed and get clarification from local lawyer.

A.Dear Client,
Nothing stops a co owner from selling your share but the buyer will have to file a suit for partition to get the possession. The co-owner can sell or transfer his portion only when he has exclusive rights to that portion of the property. If the exclusive rights are not entitled to each co-owner, such transfer of rights cannot take place without the consent of other joint co-owners. you can get the partition and then share the property between that buyer and you.
