My wifes uncle was never married and had a property of his own, my brother in law along with his wife and kid were residing with him in 2018 my wifes uncle died and then society called us and told that there had been a nomination made by the deceased person in 2006 in which 3 person were nominated along with their shares in which one is my wife and other 2 are deceased sisters son's. as per the society law , society transfered the share certificate in our name , this process took 2 years and in between my brother in law also died and now his wife and her 2nd husband is residing there and they are not having illegal possesion now and they are not vacating, we want a vacate possesion. We are paying all the dues of societies since the death of deceased. Can we get flat ownership on the basis of nomination and share transfer. or what is the way to vacate the flat

A.Dear Client,
since the share is transferred, you can issue them an eviction notice from the court if the house comes under your share.
