Eviction ordered. But still, the tenant has not handed over the premise. He filed the appeal without giving the rent as well and the rent pending at the moment is more than 11 lakhs.

How can we file the case to attach the tenant property for the surety if the tenant dragging the case wilfully not to pay the rent. The tenant intention is enjoying the premise without paying the rent.

Kindly advise what petition at the moment from our side requires to be filed to keep his property as a security. Otherwise, as per his intention, he will move away without paying the so far pending rent.

Please note that WE made the application to pay the whole rent in his appeal case. If not paid, we ask the court to strike off the appeal. However, my question is how to legally make his asset / property held liable for our sofar unpaid rent. If we do not keep his property as a security, his intention to cheat the landlord will succeed from the eyes of law in the court.

A.Dear client, in my humble suggestion, if the tenant has neither given the rent for a long nor is vacating the house, then you can approach a civil court for damages for the loss that you have suffered due to the problem, both physical as well as mental. You can also approach the Rent Control Board, through an application requesting the Board to decide the matter and direct the tenant to either give the complete rent or vacate the house.
