Iam shop owner Rakesh chandwani I suit filled against tenant for vacant shop in kota (rajasthan) I win case and district Court order to tenant to vacant shop if not vacant then 3 times rent to pay landlord but tenant appeal in high court and he demands give time to vacant the shop and high court gave 1.5 years to tenant for vacant the shop my question is can landlord has right to receive 3 time rent from tenant as per the order of district Court till vacant the shop ?

When the tenant went to the High Court then while the order/judgement was recorded then your lawyer should have beseeched the court to add the line that you can receive the three times of rent as per the order passed by the lower court.

A.If the judgement of the High Court has not mentioned about the rent being paid ( 3 times) by the tenant, then the landlord is not entitled to it. The HC judgement will be upheld over the district court's order. So, if the court has only given time to vacate, then the rent cannot be claimed by the landlord.
