maintainence during rcr case
I am 31 yr Hindu male.1.5 yrs of marriage. Wife left home 9 months ago . I put RCR application. Court asked her to put her statement on next hearing. She is doing BAMS undergraduation. I am doing my post graduation. I have stipend (not salary) of 10000 per month. If she asks for maintainence- 1.how much amount will court order as I need at least 10000 for my daily expenses in metro city. 2.for what duration I have to give maintainence. 3.will I have to give money for her education or only for daily expenses and travelling because she is in private college and she took admission before marriage and I can't afford that. 4.only my income is considered or my family's income also considered??

U filed RCR.. but she is asking maintenance ... It means she is totally not intended in this marriage.. it means ..
She left Ur home by herself.
No maintenance or alimony for deserted women by herself with out reason or by not having interest with u.
2) Ur wife is well educated..and she can maintain by her self. And not having any interest with u then Why should u give her maintenance?
Well educated wife and deserted by herself.. will Not entitle with any kind of maintenance or alimony..
That too u r still studying..u r not getting any salary.

No maintenance is decided in RCR unless wife files separate case for maintenance under CrPC 125 and other relevant laws on justifiable grounds for living separate from her husband.
Nothing to bother. The court will be lenient in your case.

On the basis of your income only maintenance to your wife will be fixed. Project your stipend income and your needs according to your city cost of living. Engage an expert advocate and proceed with the case.
