Access Entitlement to inherited property
I own one agricultural land and one paddy field as inherited property (by deed from Father ) and has walking access (no vehicle access ) through my brothers property for more than 40 years. Brother doesn't allow vehicle access. My question is can I or my successors or if I donate to someone or a third party have the legal right to continue the walking access? Whether my brother or his family members can stop or prevent us from using this access path. There is no other road or any direct access to thede two properties.
A.Dear Client,
You can still have the walking acess if it is not causing any damage to there property. If later on they cause any disturbance then you can simply ask them for using it only for walking purpose.
