Auction of property under Sarfaesi Act

One of my neighbour say 'A' had borrowed some amount of money from the bank in the year 2000 and that personality is no more now. He died in 2003. An year after his demise, one of his Son had also left for heavenly abode. Another Son had left the house before the death of his Father and is not traceable. Now A's wife is also not traceable. The building where they were living belongs next to us. That building is completely ruined, disintegrated. People nearby are using it for Peeing purpose and garbage house. I wish to purchase this property but Bank Manager is not co-operating with me to buy it.

You may go to High Court and file a Writ Petition against the Bank to issue a direction to facilitate you to purchase the said property which is not claimed by anybody.

To take over an abandoned property, one needs to make sure that there is no one else who can be traced back to the property and so you cannot just try to get the same. You can consult and advocate and research the family tree and then only try for the same.
