I currently reside in Assam and my family falls under the Below Poverty Line (BPL) category. Recently, my father underwent brain tumor surgery and is now medically unfit, requiring monthly medication costing around 4K. To support my family financially, I am providing private tuitions while also preparing for the civil service exam. We are facing significant financial challenges. In order to avail reservation benefits, I intend to apply for an Economically Weaker Section (EWS) certificate as a general category candidate. However, our residential property is 1 katha 5 lechas in size and is situated on government land, without any lease deeds in our possession. Can I still apply for an EWS Certificate under these circumstances?

Economically Weaker Sections (EWS) in India, including those categorized as "Below Poverty Line (BPL)," lack a single, consistent definition and vary depending on government schemes. EWS certificates are issued to individuals meeting certain criteria, irrespective of caste or religion. Eligibility criteria for an EWS certificate include an annual family income below Rs. 8 lakhs, ownership of less than 5 acres of agricultural land, residential flat area below 1000 sq ft, and residential plot area below 100 sq yards in notified municipality sectors or 200 sq yards in non-notified municipality sectors. The certificate is valid for one year and can be obtained from the competent authority such as the DM/SDM/Tehsildar's office.

A.Dear Sir,
As per the definition of EWS the said property not belongs to you and your parents as per records as such without showing that property you can get EWS Certificate.

A.Dear Client,
The definition of EWS may include those categorized as “Below Poverty Line (BPL)”. There is no coherent single/unique definition for EWS in India. It is defined differently for different schemes run by the Government. EWS certificates are typically issued to individuals belonging to economically weaker sections of society, regardless of their caste or religion. The criteria that qualify a person to apply for an EWS Certificate are 1) The Candidate's annual family income must be less than Rs. 8 lakhs per annum. 2) Their family must not own more than 5 acres of agricultural land. 3) the residential flat area should be below 1000 sq ft. 4) The residential plot's area should be below 100 square yards if in a notified municipality sector. 5) The residential plot's area should be below 200 square yards if in a non-notified municipality sector. An EWS certificate remains valid for one year from the date of issue. If you meet these criteria, you can apply for the issue of EWS Certificate to the competent authority. You may visit the office of DM/SDM/Tehashilder for more information/clarification in this regard.
