In case of working woman and case of 498 A is filed and woman is staying in a rented house so does she has a right to live at her husband's house and if husband denies her entry in that house whether woman ask for rent for the house in which she is living?
A.In India, a woman who has filed a case under Section 498A of the Indian Penal Code (IPC) against her husband or in-laws does not automatically have the right to reside in her husband's house. However, a woman can file a petition for maintenance under the provisions of the Protection of Women from Domestic Violence Act, 2005, seeking monetary relief and the right to reside in the shared household.
If the woman is staying in a rented house, she does not have a right to claim rent for her husband's house where she is not residing. However, she can claim maintenance from her husband for her livelihood and other expenses, which may include rent for the house in which she is living.
