A.In India, a woman who has filed a case under Section 498A of the Indian Penal Code (IPC) against her husband or in-laws does not automatically have the right to reside in her husband's house. However, a woman can file a petition for maintenance under the provisions of the Protection of Women from Domestic Violence Act, 2005, seeking monetary relief and the right to reside in the shared household.

If the woman is staying in a rented house, she does not have a right to claim rent for her husband's house where she is not residing. However, she can claim maintenance from her husband for her livelihood and other expenses, which may include rent for the house in which she is living.

The amount of maintenance that a woman is entitled to receive depends on various factors such as the income of the husband, the standard of living, the needs and expenses of the woman, and the number of dependents. The maintenance amount may be fixed by a court or negotiated between the parties with the help of their lawyers. It is advisable to consult a lawyer who specializes in family law to understand the legal rights and options available to the woman in such cases.
