Hi,
After my brothers demise my sister in law says she wants to claim his pf, which he has written 100%in her name, still she has said that she requires an NOC from me and my Dad, is this legit

A.dear client the provident fund balances are payable to the nominee in the first instance In the instant case it is written 100% in the name of spouse no need for NOC.

A.As per EPF Act a member who joins the EPF Scheme is required to furnish declaration and Nomination form in the prescribed Form No 2 (Revised) to his employer for onward transmission to Regional Provident Fund Commissioner Concerned. This nomination form enables the member to give details of his nominee for provident fund. In case of death of a EPF member, the provident fund balances are payable to the nominee in the first instance In the instant case it is written 100% in the name of spouse no need for NOC.

A.Hello,
The NOC (no objection certificate) from you is needed for the Succession Certificate which is granted by Courts in India to the legal heirs of a person dying intestate leaving debts and securities.

A.Your NOC is required for succession certificate.
Without succession certificate she can't claim.
