Which jurisdiction (which city will my trial run in) will apply in case of an inter-state 376 and 506/383 case? The guy and girl belong to 2 different states and the sexual offences also happened in both states on false marriage promise. Will the state where the first act of consummation happened apply or the last sexual incidence will count, or either?

A.Dear Client!

Mere promise for marriage and then refusing the same will not amount to a rape. There are many Judgments passed by various High Courts and recently Bombay High Court has passed the Judgment.

Is the Girl happen to be a minor or 18 years of age? lot of things needs to be considered before going ahead With the complaint.

With regards to the jurisdiction you can file the complaint before any jurisdiction where crime took place and it is advisable to file it where the girl resides.

A.Dear Client,
Under normal circumstances, the case shall be inquired and tried by a court under whose jurisdiction the offence has been committed according to Section 177.
