Hi,
We planned to move into our own house and there are few alterations to be made , so we told tenants 3 months before to vacate so that we have sometime for the alteration work before we move in. It's been 2 months already but they are asking for another 2 more months to vacate and not even confirming that they would vacate.we cannot extend the period more than 3 months as in agreement but they are not okay with it. Only proof I have is the sms I sent to vacate though orally I have asked them multiple times. They are also not paying rent on time. Can I send legal notice? Will sms be considered as proof?

Can we send legal notice now to vacate by may 10 as we have informed them verbally on Feb 10th to vacate. Agreement has 3 months notice which we verbally informed but they are not ready to vacate by may 10. They are mentally harassing us. If I go legally will it take more time? Please advise.
