On April 23rd night around 10:30 pm, I was met with an accident and the opposite party was negligent and drunk. In the accident my right leg ankle was twisted and the opposite party left leg was fractured. On 4th May they filed a case against me as rash driving. Police called me on 2nd of June morning and I myself came to the station and surrendered my vehicle. Now they are not proceeding the investigation in a proper manner and its already been 5 days of waste of time visiting the police station daily and i m not able go to my job. I want to know whether the case is valid and can i file a case against them

A.Hello,
As per the information you have mentioned you can file FIR against the opposite party for rash and negligent driving , if the other party has taken MLC and presented it to the police then it will more difficult for you .
For better clarity you can have consultation with an advocate.
