I am owner of land, we want to sold the land so we made sale agreement for 3mounths with 25% token amount, due to land price gone down so he did not submit remaining amount. He ask to extend 15 days more. I have accepted with taking 2 lac rupees more after 15 days he is not willing to pay remaining. After 1 year I got notice from court that he is ready for registration. He is extended time in next 2 page miss using the map. That is plan txt.
My question is reusing 10 rupees stamp paper is it valid ?
A.Dear client,
Under the registration act the sale deed has to be registered within 4 months from the date of its execution and this period can further be extended to another 4 months
A document can be registered max within 8 months from the date of its signing on payment of penalty with the registration fee
Answering your question, As per Section 54 of the Indian Stamp Act, if you do not have any immediate use of a stamp paper, then you can deposit it back to the collector within six months from the date of purchase and take back your money as a refund after deduction of 10 paise per rupee.
In Thiruvengada Pillai Vs. Navaneethammal & Anr, it was held by the Supreme Court that a stamp paper, even if it is more than six months old, is valid to be used. Section 54 just bars taking refund after six months of purchase, but it does not restrict the use of such old stamp paper for an agreement. Thus, nothing prohibits you from using it even after years of its purchase. Law does not have any prescribed period of limitation for its validity.
